Please read these Terms of Use before using eatandbloom.com (the "Site"), published by Eat & Bloom Media, operated by Emma Vance (editorial name: Emma Bloom) ("we", "us", "Eat & Bloom"). By accessing or using the Site you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

Who may use the Site

The Site is intended for adults. By using it you confirm that you are at least 18 years old, or that you use it with the involvement of a parent or guardian. Children under 13 should not submit personal data (see our Privacy Policy).

Informational content only

The content is for general information. It is not medical, nutritional or professional advice. Please read our Disclaimer & FAQ, which forms part of these Terms.

Intellectual property

The Site and its content (articles, recipes, text, images, layout, logos and the "Eat & Bloom" name) belong to Eat & Bloom Media, operated by Emma Vance (editorial name: Emma Bloom) or are used with permission, and are protected by intellectual property laws.

  • You may: view the Site for personal, non-commercial use; print a recipe for your own kitchen; share links to our pages; quote a short excerpt (under 50 words) with a visible link to the original page, for commentary or education.
  • You may not, without our prior written permission: copy, republish, translate or redistribute full articles, recipes or photos, or substantial parts of them, on another site, app, newsletter, video or product.

Scraping and AI training

Unless we have agreed otherwise in writing, you may not use bots, crawlers or other automated means to copy or collect content from the Site at scale, and you may not use the content to train, fine-tune or ground artificial intelligence or machine learning models, or to build datasets, aggregators or content farms. Search engines and tools that respect our robots.txt may index the Site in the normal way.

Acceptable use

You agree not to:

  • break the law or infringe someone else's rights;
  • post spam, advertising, malware or content that is unlawful, hateful, harassing, misleading or that contains personal data of others;
  • try to access systems, accounts or data you are not authorised to access, or disrupt or overload the Site;
  • misrepresent our content or suggest that we endorse you or your products.

Comments and ratings

Comments are moderated before publication. You are responsible for what you write. By posting a comment you give us a non-exclusive, free licence to publish, display and, where needed, edit or remove it on the Site. We may reject, edit or delete any comment for any reason, and we may restrict access to anyone who abuses these features.

Links to other websites

The Site may link to third-party websites or services that we do not own or control. We are not responsible for their content, policies or practices, and a link is not an endorsement. We advise you to read their terms and privacy policies.

Suspension

We may suspend or block your access to the Site, or to parts of it, at any time and without notice, in particular if you breach these Terms.

"As is" and "as available"

The Site is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or free of harmful components, or that its content will be accurate or complete.

Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, or for loss of profits, data or goodwill, arising from your use of, or inability to use, the Site or its content, including any health, dietary, food-safety or financial outcome. Where liability cannot be excluded, our total liability is limited to 100 US dollars. Nothing in these Terms limits liability that cannot be limited by law, and some jurisdictions do not allow certain exclusions, so some of the above may not apply to you.

Governing law and disputes

These Terms are governed by the laws of the State of New York, United States, excluding its conflict-of-law rules. Before starting any formal proceeding, please contact us at hello@eatandbloom.com so that we can try to resolve the matter informally. Any dispute that cannot be resolved is subject to the jurisdiction of the state and federal courts located in New York, United States.

If you are a consumer in the European Union or the United Kingdom, you keep the benefit of the mandatory consumer-protection rules of the country where you live.

General

If a provision of these Terms is found invalid or unenforceable, the rest remains in force, and the provision is applied to the extent allowed by law. Our failure to enforce a right is not a waiver of it. If these Terms are translated, the English version prevails in case of conflict.

Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the latest revision, and continuing to use the Site after a change means you accept the updated Terms.
